A trade mark can often be the most valuable asset that a company owns. A trade mark is any sign which is used in the course of trade to distinguish the goods and/or services of one trader from those of another. A trade mark can be a word, a logo, a slogan, a jingle, a colour, a combination of letters or numbers, or even a form of packaging.
All companies have at least one trade mark (i.e. the company name) and most spend a great deal of time and money in promoting their trade mark to their customers. By registering your trade mark you can prevent other parties from using the same or similar trade mark in respect of the same or similar goods and/or services.
Page Hargrave can assist in all aspects of the trade mark process. It is preferable to involve us as early as possible so that we can conduct availability searches to ensure that any proposed trade mark is free for you to use. If availability searches are not conducted then it is possible that you may have to withdraw products and/or promotional material if a conflicting registered trade mark subsequently comes to light. Once a trade mark has been selected and cleared we can assist in the filing of a trade mark application and we can take the application through to grant.
We are able to act before the UK Intellectual Property Office and the European Trade Mark Registry and we can file applications in most other countries throughout the world through our network of trusted associates. Once registered we can assist in the management of your trade mark portfolio, including maintaining a watching service to identify potentially conflicting later applications and attending to the renewal of your trade marks. We can also advise you in respect of any infringements of your trade marks.
